1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Patron," "you," or "your") and Lexie's Bistro on Raiders Lane LLC, doing business as Lexie's Bistro ("Company," "we," "us," or "our"). By accessing our premises, using our website, making reservations, dining at our establishment, or participating in any gaming activities, you agree to these Terms in their entirety.

If you do not agree to these Terms, you must not enter our premises or use our services.

We reserve the right to modify these Terms at any time without prior notice. Your continued use of our services following any changes constitutes acceptance of those changes. It is your responsibility to review these Terms periodically.

2. Gaming Activities — Terms and Conditions

2.1 Age Verification and Identification

• You must be 21 years of age or older to enter our gaming lounge or participate in any gaming activities.
• Valid government-issued photo identification is required and must be presented upon request.
• We reserve the right to refuse entry or service to anyone who cannot provide valid identification.
• Providing false identification or misrepresenting your age is a violation of Nevada law and these Terms.

2.2 Assumption of Risk

BY PARTICIPATING IN GAMING ACTIVITIES, YOU EXPRESSLY ASSUME ALL RISKS associated with such activities, including but not limited to:

• Financial loss of any amount wagered
• Addiction or compulsive gambling behaviors
• Emotional distress related to gambling outcomes
• Any physical injury occurring in the gaming area

You acknowledge that gambling involves an inherent risk of loss and that you are solely responsible for your gambling decisions and any resulting consequences.

2.3 No Liability for Gaming Losses

THE COMPANY SHALL NOT BE LIABLE FOR ANY GAMBLING LOSSES you incur, regardless of amount. This includes losses resulting from:

• Normal game play and outcomes
• Machine malfunctions (in such cases, all plays are void)
• Power outages or technical failures
• Your misunderstanding of game rules or odds
• Decisions made while under the influence of alcohol or any substance

2.4 Gaming Equipment Disclaimer

All gaming equipment, including video poker machines, slot machines, and table game equipment, is provided "AS IS" WITHOUT ANY WARRANTIES, express or implied, including warranties of merchantability or fitness for a particular purpose. The Company does not guarantee:

• Uninterrupted operation of any gaming equipment
• Any specific payout rates or winning percentages
• The accuracy of displayed information during equipment malfunction

IN THE EVENT OF A MACHINE MALFUNCTION, ALL PAYS AND PLAYS ARE VOID.

2.5 Nevada Gaming Regulations

All gaming activities are conducted under the jurisdiction and regulations of the Nevada Gaming Control Board and the Nevada Gaming Commission. By participating in gaming activities, you agree to comply with all applicable Nevada gaming laws and regulations. The Company operates under license from the State of Nevada and is subject to regulatory oversight.

2.6 Self-Exclusion and Responsible Gaming

If you have a gambling problem, resources are available. By using our gaming services, you acknowledge:

• You are not on the Nevada Self-Exclusion List
• You have not been excluded or banned from gaming establishments
• You are not participating in gaming activities in violation of any court order

3. Restaurant and Dining Terms

3.1 Food Allergies and Dietary Restrictions

THE COMPANY SHALL NOT BE LIABLE for any allergic reactions, adverse health effects, or injuries resulting from the consumption of food at our establishment, except in cases of gross negligence. By ordering and consuming food, you assume all risks associated with food allergies and dietary sensitivities.

3.2 Assumption of Risk — Food and Beverage

You acknowledge and assume all risks associated with the consumption of food and beverages, including but not limited to:

• Foodborne illness
• Allergic reactions
• Choking hazards
• Effects of alcohol consumption
• Injury from hot foods or beverages

3.3 Reservations and Cancellations

• Reservations are subject to availability and confirmation.
• We request cancellation notice at least 24 hours in advance.
• Large party reservations (6 or more) may require a deposit or credit card guarantee.
• No-shows or late cancellations may result in charges to the card on file.
• We reserve the right to release reserved tables after a 15-minute grace period.

3.4 Right to Refuse Service

We reserve the right to refuse service to any patron at our sole discretion, including but not limited to situations involving:

• Intoxication or impairment
• Disruptive, abusive, or inappropriate behavior
• Violation of these Terms or house rules
• Failure to provide valid identification when requested
• Previous banning or exclusion from the premises
• Health or safety concerns

4. Limitation of Liability

4.1 Maximum Liability Cap

IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY to you for all claims arising out of or relating to these Terms, your visit to our premises, or use of our services exceed the greater of: (a) the amount you paid to the Company in the 30 days preceding the claim, or (b) One Hundred Dollars ($100.00).

4.2 Disclaimer of Warranties

ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The Company does not warrant that:

• Services will meet your requirements or expectations
• Services will be uninterrupted, timely, secure, or error-free
• Any gaming equipment will operate without malfunction
• Any defects will be corrected

4.3 Personal Property

THE COMPANY IS NOT RESPONSIBLE FOR LOST, STOLEN, OR DAMAGED PERSONAL PROPERTY. You are solely responsible for safeguarding your belongings while on our premises. This includes but is not limited to clothing, electronics, jewelry, cash, gaming chips, and vehicles parked on or near our property.

4.4 Third-Party Services

We are not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any third-party service providers, including but not limited to payment processors, delivery services, reservation platforms, and entertainment providers.

5. Indemnification

You agree to indemnify, defend, and hold harmless Lexie's Bistro on Raiders Lane LLC, its owners, officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of our services or premises
• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of any third-party rights
• Any claim that your conduct caused damage to a third party
• Your gaming activities and any disputes arising therefrom

6. Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond the Company's reasonable control, including but not limited to: acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, civil unrest, government actions, power failures, internet or telecommunications failures, fire, flood, or other catastrophic events.

7. Dispute Resolution and Governing Law

7.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada.

7.2 Informal Resolution

Before filing any formal legal claim, you agree to contact us at info@lexiesbistro.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving your notice.

7.3 Waiver of Class Actions

YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER in any purported class, collective, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Company.

7.4 Limitation Period

Any claim or cause of action arising out of or related to these Terms or your use of our services must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

8. General Provisions

8.1 Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

8.2 Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding your use of our services and supersede all prior agreements, understandings, and communications, whether written or oral.

8.3 No Waiver

The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

8.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. The Company may assign these Terms without restriction.
